Welcome to https://www.targetindicators.com (the “Site”), operated by Target Indicators (“Target Indicators,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and the purchase of products from us. By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Site.

1. Eligibility

You must be at least 18 years old to purchase products from this Site. By placing an order, you represent that you have the legal capacity to enter into a binding agreement.

2. Products and Orders

a. Physical Products Only

Target Indicators sells physical products only, including made-to-order and custom items. All product descriptions and images are provided for general reference. Minor variations may occur.

b. Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including for errors in pricing, product availability, or suspected fraud.

c. Customer Satisfaction Commitment (Non-Binding)

Your satisfaction matters to us. If you are unhappy with your order, we encourage you to contact us so we can review the situation and, at our sole discretion, determine whether a reasonable resolution is appropriate.

This customer satisfaction commitment is a voluntary goodwill gesture only and does not create any legal obligation, guarantee, waiver, or modification of these Terms, including our policies on custom items, returns, refunds, or order acceptance.

3. Custom and Made-to-Order Items

Custom and made-to-order items are created specifically for you and are subject to the following terms:

  • Final Sale: All custom and made-to-order products are final sale and are not eligible for returns or refunds.
  • Proof Approval: Customers are responsible for reviewing and approving all proofs prior to production. Approval constitutes acceptance of the design.
  • Variations: Minor variations in size, placement, stitching, materials, or appearance are inherent in custom manufacturing and are considered acceptable.

4. Returns and Refunds (Non-Custom Items Only)

We accept returns on non-custom, non-made-to-order items subject to the following conditions:

  • Returns must be requested within 15 days of receipt of the product.
  • Items must be unworn, unused, unsoiled, and in original condition.
  • Tags and stickers must remain attached and intact.
  • Customers are responsible for return shipping costs.
  • Refunds will be issued to the original payment method after inspection and approval.

We reserve the right to deny returns that do not meet these conditions.

5. Shipping and Delivery

a. Shipping Locations

We ship to: – The United States – FPO/APO/DPO addresses

We do not ship internationally or to freight forwarders or package forwarding services.

b. Processing and Delivery Times

Processing and delivery times are estimates only and are not guaranteed. Delays may occur due to carrier issues, weather, supply chain constraints, or other factors beyond our control.

6. Pricing and Payments

All prices are listed in U.S. dollars unless otherwise stated. Payment must be received in full at the time of purchase. We use secure third-party payment processors to handle transactions.

7. Intellectual Property

All content on the Site, including text, images, logos, designs, and product photos, is the property of Target Indicators or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without our prior written permission.

Customer-Provided Content

If you submit designs, logos, images, or other materials for custom products, you acknowledge and agree that:

  • You represent that you have the right to submit the content for the purpose of producing the requested product, but you are not required to hold exclusive ownership rights to that content.
  • Target Indicators does not verify or confirm ownership, licensing, or exclusivity of customer-submitted content.
  • You assume all responsibility for any claims, disputes, or legal issues arising from the use of customer-submitted content.
  • You grant Target Indicators a non-exclusive, royalty-free license to use, modify, reproduce, and display the submitted content solely as necessary to fulfill your order and maintain business records.

8. Ownership of Created Content

All designs, artwork, layouts, mockups, photographs, marketing materials, product images, website content, and related creative works created by Target Indicators are the exclusive property of Target Indicators, unless otherwise agreed to in writing.

  • We retain full ownership of all original creative work we produce, including but not limited to artwork, digital files, product photos, promotional images, and written content.
  • Vector files, source files, and editable design files are not provided unless explicitly stated or agreed to in writing.
  • Purchase of a product does not transfer intellectual property rights to the underlying design or creative assets.

Target Indicators reserves the right to display completed work, product images, and related content for portfolio, marketing, advertising, and promotional purposes.

9. SMS Communications

If you opt in to receive SMS or text messages from us:

  • Your consent is used solely for providing those communications.
  • SMS consent is not shared with third parties or affiliates for marketing or promotional purposes.
  • Message frequency may vary.
  • Standard messaging and data rates may apply.
  • You may opt out at any time by replying STOP or request assistance by replying HELP.

9. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose
  • Submit false or misleading information
  • Attempt to gain unauthorized access to the Site or systems
  • Copy, scrape, or misuse Site content or intellectual property
  • Engage in abusive, fraudulent, or harmful conduct toward Target Indicators or its staff

We reserve the right to terminate access for violations of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Target Indicators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or purchase of products.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Target Indicators from any claims, damages, losses, or expenses arising out of your violation of these Terms or misuse of the Site.

13. Force Majeure

We shall not be liable for delays or failures resulting from causes beyond our reasonable control, including natural disasters, acts of war, labor disruptions, carrier delays, or governmental actions.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles.

15. Dispute Resolution

Before initiating any legal action, you agree to first contact us at privacy@targetindicators.com to attempt to resolve disputes informally.

If a dispute cannot be resolved informally, either party may pursue claims in a court of competent jurisdiction in the State of Tennessee.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be effective upon posting to the Site with an updated effective date. Continued use of the Site constitutes acceptance of the revised Terms.
